1. INTRODUCTION

1.1 Organization Overview

Legacy Performance (“we,” “us,” “our,” or the “Organization”) is a physical training organization specializing in football training for youth athletes based in San Diego, California. We provide specialized training services for minors aged 8 to 14 years old, focusing on football skills development and physical conditioning.

1.2 Facility Usage

Legacy Performance conducts in-person training sessions at Cathedral Catholic High School facilities, specifically the weight room at the Claver Center and the practice football field (Lower Field). Please note that Legacy Performance is not a program of Cathedral Catholic High School; we merely utilize their facilities through a separate agreement.

1.3 Purpose of Terms

These Terms of Service (“Terms”) govern your access to and use of the Legacy Performance website (https://legacyperformancesd.com) and participation in our training programs. By accessing our website or enrolling your child in our programs, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. SERVICES OFFERED

2.1 Training Programs

Legacy Performance offers specialized football training for youth athletes aged 8-14, including but not limited to:

  • Fundamental football skills development

  • Speed and agility training

  • Strength and conditioning appropriate for youth athletes

  • Position-specific technical instruction

  • Athletic performance assessment and development

2.2 Website Services

  • Information about our training programs

  • Registration for training sessions

  • Educational resources for athletes and parents

  • Contact information for inquiries

3. REGISTRATION AND PARTICIPATION REQUIREMENTS

3.1 Enrollment Process

To enroll your child in Legacy Performance programs, you must:

  • Complete all required registration forms

  • Provide accurate information about your child’s health and physical condition

  • Submit all required waivers and consent forms

  • Pay applicable program fees

3.2 Health Requirements

All participants must:

  • Be in good health and physically capable of participating in athletic activities

  • Have had a physical examination within the past 12 months clearing them for athletic participation

  • Disclose any medical conditions, allergies, or medications that could affect participation

4. FACILITY SAFETY PROTOCOLS

4.1 Weight Room (Claver Center) Protocols

  • All participants must be supervised by Legacy Performance staff at all times

  • Proper technique instruction will be provided before equipment use

  • Age-appropriate equipment and weights will be utilized

  • Regular equipment safety checks are conducted

  • Participants must wear appropriate athletic attire and closed-toe athletic shoes

  • Food, glass containers, and unauthorized equipment are prohibited

4.2 Football Field (Lower Field) Protocols

  • Field inspections are conducted before each session to identify hazards

  • Weather conditions are monitored, and activities modified or canceled as needed

  • Proper hydration breaks are scheduled during all training sessions

  • Appropriate protective equipment must be worn when specified

  • Contact drills are conducted according to age-appropriate guidelines

4.3 General Safety Measures

  • Coach-to-athlete ratios are maintained at appropriate levels based on activity

  • First aid kits are accessible at all training locations

  • At least one staff member certified in CPR and First Aid is present at all sessions

  • Clear emergency procedures are established and communicated to all staff

  • Structured warm-up and cool-down activities are included in all sessions

5. ASSUMPTION OF RISK

5.1 Inherent Risks

Participation in athletic activities, including football training, involves inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. These risks include, but are not limited to:

  • Minor injuries such as scratches, bruises, and sprains

  • Major injuries such as joint or back injuries, broken bones, heart attacks, and concussions

  • Catastrophic injuries including paralysis and death

5.2 Assumption of Risk Acknowledgment

By enrolling your child in Legacy Performance programs, you acknowledge and expressly assume all risks, both known and unknown, associated with participation in our activities, even if arising from the negligence of the Organization or others, and assume full responsibility for your child’s participation.

6. WAIVER AND RELEASE OF LIABILITY

6.1 Release of Claims

In consideration of being allowed to participate in Legacy Performance programs and activities, you, on behalf of yourself and your minor child, hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Legacy Performance, its owners, directors, officers, employees, volunteers, and agents (collectively, “Releasees”) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by your child or to any property, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES or otherwise, while participating in such activities or while in, on, or upon the premises where the activities are being conducted.

6.2 California Civil Code Section 1542

You expressly waive the provisions of California Civil Code Section 1542, which provides:
“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

6.3 Limitation of Liability

The waiver and release contained herein applies only to ordinary negligence and does not apply to gross negligence, recklessness, or intentional misconduct by Releasees. Nothing in these Terms shall be construed to waive any rights that cannot be legally waived under California law.

7. PARENTAL CONSENT AND RESPONSIBILITIES

7.1 Parental Authorization

By enrolling your child in Legacy Performance programs, you represent and warrant that you are the legal parent or guardian of the child and have the legal authority to enter into this agreement on the child’s behalf.

7.2 Parent Responsibilities

Parents and guardians agree to:

  • Ensure their child follows all safety rules and instructions given by staff

  • Provide accurate health information and promptly update if changes occur

  • Ensure proper nutrition and hydration before training sessions

  • Provide appropriate athletic attire and equipment

  • Ensure punctual drop-off and pick-up at designated times and locations

  • Maintain respectful communication with staff and other participants

7.3 Behavioral Expectations

Parents are responsible for their child’s behavior during participation in our programs. Disruptive or unsafe behavior may result in temporary removal from activities or, in severe cases, dismissal from the program without refund.

8. MEDICAL AUTHORIZATION

8.1 Emergency Medical Consent

In the event of injury or illness requiring emergency treatment, you authorize Legacy Performance staff to secure appropriate medical treatment for your child. You understand that reasonable attempts will be made to contact you before such action is taken.

8.2 Medical Expenses

You acknowledge and agree that any medical expenses incurred will be your responsibility. Legacy Performance does not provide health or accident insurance for participants.

9. PHOTO AND VIDEO RELEASE

9.1 Media Consent

By enrolling your child in Legacy Performance programs, you grant permission for the Organization to take photographs and videos of your child during participation in our activities and to use these images in promotional materials, social media, and on our website.

9.2 Opt-Out Provision

Parents may opt out of photo/video usage by submitting a written request to the Organization. However, this will not apply to group photos or videos where your child is not the primary subject.

10. ONLINE PRIVACY AND DATA COLLECTION

10.1 Website Privacy

Our website collects certain information as described in our Privacy Policy. By using our website, you consent to the collection and use of information as detailed in that policy.

10.2 Youth Privacy

We comply with all applicable laws regarding the collection of information from children under 13 years of age, including the Children’s Online Privacy Protection Act (COPPA).

11. SCHEDULE CHANGES AND CANCELLATIONS

11.1 Program Modifications

Legacy Performance reserves the right to modify or cancel training sessions due to weather conditions, facility issues, insufficient enrollment, or other circumstances beyond our control.

11.2 Refund Policy

Refund eligibility varies based on timing of cancellation and the specific program. Please refer to the enrollment materials for the applicable refund policy.

12. CODE OF CONDUCT

12.1 Athlete Conduct

All participants are expected to:

  • Follow instructions from coaches and staff

  • Respect the rights and feelings of other participants

  • Refrain from physically or verbally abusive behavior

  • Practice good sportsmanship

  • Follow all safety rules and protocols

12.2 Parent/Guardian Conduct

All parents and guardians are expected to:

  • Support a positive training environment

  • Respect coaches, staff, and other parents

  • Address concerns privately with appropriate staff

  • Refrain from sideline coaching during sessions

  • Model good sportsmanship for all participants

13. GOVERNING LAW AND DISPUTE RESOLUTION

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law.

13.2 Dispute Resolution

Any dispute arising from these Terms or participation in Legacy Performance programs shall first be addressed through informal negotiation. If the dispute cannot be resolved informally, the parties agree to attempt resolution through mediation in San Diego County, California, before resorting to arbitration or litigation.

14. MODIFICATION OF TERMS

Legacy Performance reserves the right to modify these Terms at any time. Updated Terms will be posted on our website, and continued participation in our programs constitutes acceptance of the modified Terms.

15. SEVERABILITY

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

17. ACKNOWLEDGMENT

BY ENROLLING YOUR CHILD IN LEGACY PERFORMANCE PROGRAMS OR USING OUR WEBSITE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT ENROLL YOUR CHILD IN OUR PROGRAMS OR USE OUR WEBSITE.
